PRIVACY POLICY

This privacy policy ("Privacy Policy") describes the types of information 14511981 Canada Inc. (o/a Marketingscape)   ("we," "us" and "our") may gather or collect from or about you or that you may provide when you visit our website (collectively, the "Site") and our practices for collecting, using, maintaining, protecting and disclosing that information. This Privacy Policy applies to your information we collect on the Site and in email, text, and other electronic messages between you and us or provided by third parties. Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. Occasionally, this Privacy Policy may be modified. The procedures for modifying or changing this Privacy Policy in the future are discussed in the “effective date and update to the privacy section” Section ("Effective Date and Updates to This Privacy Policy").

AGE RESTRICTION

Our site is not primarily for children under the age of 18. We do not purposely gather personal data from children below the age of 18. If you are under 18, do not use or provide information on this site. If we find that we have collected or received personal information from a child under 18, we will delete their information. If you believe we may have some information about a child under the age of 18, kindly contact us via our email addresses

TYPES OF INFORMATION WE COLLECT

We collect various types of information from and about users of the Site, including information: among which you can be individually identified, such as name, postal address, e-mail address, telephone number, credit card number and any other identifier through which you can be reached online or offline ("personal information");

  • That concerns you but individually it does not identify you, such as your age, and your interest. and use of various products, programs, and services; or

  • About your Internet connection and the equipment you use to access the Site, such as usage details and IP addresses.

PERSONAL DATA THAT WE COLLECT

When you use or interact with us through the Services or engage with 14511981 Canada Inc. (o/a Marketingscape) as a sales customer or prospect, we may collect Personal Data. Personal Data is the information about you that identifies you as an individual, for example, your name, address, e-mail address, or telephone number. 

We collect information that you voluntarily provide to us through responses to surveys, search functions, questionnaires, feedback, Tell Your Story forms and the like. We may also ask you to provide additional information such as your e-mail address if you want to obtain additional services, information or to resolve complaints or concerns.

We value your privacy and are committed to providing you with options related to managing the personal information you provide to us. Here's how you can check your information:

  • Providing information:  You can always choose not to provide us with your personal information if you are not comfortable with our ability to use and share such information as set forth in this Privacy Policy. However, please note that you may not have access to some of our products and services if you choose not to provide us with your information.

  • Choose not to receive promotional emails from us: You can choose not to receive our promotional and marketing emails at any time by using the exclusion mechanism included in these emails (also called "unsubscribe") or by sending your request to your (email). Please allow 30 working days for us to process your exclusion request. Also, keep in mind that choosing not to receive promotional communications via email will only affect your future communications with us. 

  • Refusal of browser cookies and other tracking technologies: If you do not want us to monitor your information using browser cookies, you can change your browser settings to refuse cookies. Other tracking technologies such as Flash cookies can also be disabled. However, it should be noted that some areas of the site may not work properly if you decide not to accept cookies.

DATA RETENTION

We may retain your Personal Data as long as you are registered to use the Services. You may delete your account by sending us a message. However, we may retain Personal Data for an additional period as is permitted or required under applicable laws. Even if we delete your Personal Data it may persist on backup or archival media for an additional period of time for legal, tax or regulatory reasons or for legitimate and lawful business purposes. For sales customers and prospects, we retain your data as long as we maintain a relationship with you and for a limited period of thereafter as necessary to meet business and legal requirements.

DO NOT TRACK

As of right now, we are not a part of any "Do Not Track" frameworks that would enable us to react to signals or other tools provided by you about the collecting of your Personal Data.

DATA SECURITY PROCEDURES

We have implemented security measures to help protect against the loss, misuse, or unauthorized alteration of the information provided or collected. We use online and offline security methods, including firewalls, passwords, and limited physical access to the servers where your data is stored. The safety of your data also depends on you. You are the only user entitled to update your account except you provide your login details or password information to a different party. We assume that anyone with the password information required for your account is you, therefore, keep this information confidential and not share it with anyone.

Unfortunately, it is not possible to guarantee that any security system is 100% secure. At 14511981 Canada Inc. (o/a Marketingscape) we do our best to protect your personal data, but we cannot assure the security of your data. You agree and accept that any transmission of your data is at your own risk. We are not responsible for circumventing the privacy settings or security measures contained on the Site.

INFORMATION TRANSFER

We may transfer your information outside Canada where we have facilities or hire third parties, such as payment processors, or other IT service providers.

AGE COMPLIANCE

Our goal is to fully comply with international laws that respect the privacy of children, as is the case with COPPA. Therefore, we do not collect or process any data for people under the age of 13. If you are under 13 and use our platform, stop immediately, and do not send us any information. If we accidentally collect information from users under the age of 13, we will delete that information immediately. Please contact us directly if you notice that we have received information from a minor (under 13).

 

EFFECTIVE DATE AND UPDATES TO THIS PRIVACY POLICY

This Privacy Policy will be effective from the date you commence your use of our website. We hold the right to modify this Privacy Policy at any time by posting an updated Privacy Policy. We recommend that you check this page frequently for updates and revisions and update your email address if it changes. We will notify you by e-mail of any important revision of the privacy policy if you provide us with an accurate and updated email address. You will be asked to click to accept the revised privacy statement before you can continue using the site. You will not be allowed to continue using the Site unless you accept the revised Privacy Statement.

 

YOUR CALIFORNIA (CCPA) AND PERSONAL INFORMATION PROTECTION AND ELECTRONIC DOCUMENT ACTS (PIPEDA)

Access to Specific Information and Data Portability Rights

Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

  • The categories of third parties with whom we share that personal information.

  • The specific pieces of personal information we collected about you (also called a data portability request).

If we disclosed your personal information for a business purpose, one separate list disclosing:

  • Disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Deletion Request Rights

You have the right to request that 14511981 Canada Inc. delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

  • Debug products to identify and repair errors that impair existing intended functionality.

  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights or exercise another right provided for by law.

  • Comply with the California and the Canadian Electronic Communications Privacy Act 

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement if you previously provided informed consent.

  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

  • Comply with a legal obligation.

  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either a mail or call. Only you, or a person you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collect personal information or an authorized representative.

  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA and PIPEDA rights:

  • Deny your services.

  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

  • Provide you with a different level or quality of goods or services.

  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Other California Privacy Rights

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Websites that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. THE GENERAL PROTECTION REGULATION GDPR

General Data Protection Regulation (GDPR)

The General Data Protection Regulation (GDPR), a European privacy law approved by the European Commission in 2016, entered into force on May 25, 2018. The GDPR replaced the previous European Union protection directive privacy known as Directive 95/46/EC, which is based on the GDPR is an attempt to strengthen and modernize EU data protection laws and strengthen individual rights and freedoms, in line with the European concept of privacy as a fundamental human right. The GDPR regulates, among other things, how individuals and organizations can obtain, use, store, and delete personal information. In short, it allows EU citizens and residents to monitor their data while simplifying the regulatory environment for international business that takes place in the EU.

Privacy information for European citizens

We know that if you work with EU customers, you must allow them to access, update, download, and delete personal data. We got you! We respect the rights of people living in the European Economic Community (EEC) and the rights conferred on them by the General Data Protection Regulation (GDPR). This privacy statement explains how we are going to help our users living in the EEC.

  • The freedom to access, restore, or delete the information we hold about you. You can request access, update, or deletion of information directly at any time by contacting us for help.

  • Right of modification If this information is incorrect or incomplete, you have the right to correct it.

  • Objection: you have the right to object to the processing of your information.

  • Limited rights: You have the right to ask us to restrict the processing of your information.

  • Right to data portability: You also have the right to obtain a copy of the information we have about you in a structured format that is machine-readable and commonly used.

  • The right to withdraw consent: the user has the right to withdraw consent as long as 14511981 Canada Inc., relies on the user's consent to process personal information.

Before responding to these requests, you may need to confirm your identity. You have the right to complain to the data protection authorities about the collection and use of your data. Contact your local EEA data protection authority for more information.

Transfer of personal data outside the EEC

When your PII is transferred outside the EEC, 14511981 Canada Inc. will ensure that your PII has an adequate level of protection and that your information is accessible, as indicated in the privacy policy.

Disposal of information

At 14511981 Canada Inc., we value your privacy and your right to access and control your personal information. We have implemented this policy to request that all personal data stored on our system be permanently deleted. If you would like your information to be stored with us, please contact us by sending us an email and as well follow the instructions. With each deletion request, you must specify the information you want to delete as it is presented. Please note that deletion requests are not processed immediately. There may be a reasonable delay in the processing and deletion of all requested data. Although we will try to delete all of your personal information after receiving your cancellation request, please note that 14511981 Canada Inc. may have multiple areas in which your personal information is stored. A single cancellation request may not delete all your data stored on Platform. Therefore, it may be necessary to submit multiple offers. If your information reappears, please contact us.
